1. Effective Date

2. Acceptance of Terms

By creating an account on The Housing Market, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, do not create an account or use the platform.

3. Eligibility

You must be at least 18 years old to use The Housing Market. By using the platform, you represent that you have the legal capacity to enter into real-estate transactions in the State of Iowa.

4. The Service

The Housing Market is an online marketplace that connects buyers, sellers, and service-provider partners (lenders, inspectors, title companies, photographers, and similar vendors) in the Iowa City area. Real-estate brokerage services offered through the platform are provided by Real Deal Realty PLLC, an Iowa licensed real-estate brokerage based in Iowa City.

5. Account Responsibilities

You agree to keep your account credentials private and secure. One account per person — shared accounts are not permitted. You are responsible for all activity that takes place under your account, including any transactions, documents, or communications initiated from it.

6. Fees

Platform fees are never more than $10,000 per transaction. Fees are à la carte — you only pay for the services you use, and you are charged through Stripe when you proceed through a paid step. Current pricing:

• Offer Management / Purchase Agreement — $1,395

Pricing is subject to change. We will notify you of any changes before they apply to your account.

7. Documents & E-Signatures

Signatures captured on the platform are legally binding under the Iowa Uniform Electronic Transactions Act (Iowa Code Chapter 554D). Listing agreements, seller disclosures, and buyer offers executed on the platform have the same legal effect as signatures made on paper. 8. User-Generated Content

Photos, videos, descriptions, and other content you upload to the platform remain your property. By uploading content, you grant The Housing Market a non-exclusive, royalty-free license to display, reproduce, and distribute that content on the platform and in marketing materials related to your listing for as long as your listing is active.

9. Prohibited Conduct

You agree not to:

• Misrepresent a property, its condition, or its ownership.
• Post fraudulent offers or knowingly false information.
• Impersonate another user, agent, or service provider.
• Scrape, harvest, or otherwise extract the listings database or any other data from the platform by automated means.
• Use the platform for any unlawful purpose or in violation of Iowa real-estate law.

10. Disclaimer of Warranties

The platform is provided “as is” and “as available.” We do not guarantee uninterrupted service, error-free operation, or any specific outcome — including, without limitation, that a home listed on the platform will sell at any particular price or within any particular timeframe. To the maximum extent permitted by Iowa law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. 11. Limitation of Liability

To the extent permitted by Iowa law, our total liability to you for any claim arising out of or relating to these Terms or your use of the platform is capped at the total amount of platform fees you have paid to The Housing Market in the twelve (12) months preceding the event giving rise to the claim. 12. Governing Law

These Terms are governed by the laws of the State of Iowa, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms will be resolved exclusively in the state or federal courts located in Johnson County, Iowa.

13. Termination

Either party may terminate this agreement at any time. You may delete your account at any time from your account settings. We may suspend or terminate your account for any violation of these Terms — including, without limitation, any of the prohibited conduct described above.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will notify you in the app and by email at the address associated with your account. Continued use of the platform after a change takes effect constitutes acceptance of the updated Terms.
